Gunner Rutherford is buried in Vailly British Cemetery in the Department of Aisne in France. The village of Vailly-sur-Aisne was the point at which the 3rd Division crossed the river Aisne on 13 and 14 September 1914 during the Allied advance from the Marne.

The 24th Brigade of the Royal Field Artillery comprised of the 110, 111 and 112 Batteries. This brigade joined 6th Division before it sailed for France in August 1914.
Gunner Thomas Rutherford was serving with the 24th Brigade, 112th Battery of the Royal Field Artillery when he died on Wednesday 30th September 1914. He was 18 years old.
In his will Thomas leaves all to his older brother William Rutherford.
Last Will and Testament of Thomas Rutherford:
In the event of my death, I give the whole of my property and effects to my eldest brother, W Rutherford. T Rutherford. 75752. 112th Bty, Royal Field Artillery, 24th Brigade.
Gunner Thomas Rutherford is buried in Vailly British Cemetery at Vailly-su-Aisne in France. His inscription reads: FOR GOD, KING AND EMPIRE
